On June 14, 2023, Eglet Adams filed a civil complaint on behalf of a married woman in Clark County District Court against Physical Therapist Brady K. Powell and LV Premier Physical Therapy and Sports Performance (LV PPTSP) for Powell’s nonconsensual sexual touching during physical therapy sessions. The lawsuit also names Defendant Kuhn Enterprise, LLC, doing business as Premier Physical Therapy, as liable for the woman’s damages due to their employee’s actions. This is the fourth known victim who has reported Powell.
The lawsuit alleges that while undergoing physical therapy at LV PPTSP, Powell’s abuse of the medical professional-patient relationship during treatment caused the woman, who is a current military servicewoman, to feel violated, disgusted, and embarrassed resulting in severe mental anxiety with physical manifestations.
The complaint brings forth six causes of action, these include:
- Negligence- As Against All Defendants And All Named Does and Roes
- Negligent Hiring, Training, Supervision, and/or Retention- As Against Defendant Premier Physical Therapy and Sports Performance And All Named Does and Roes
- Vicarious Liability/Respondeat Superior- As Against Defendant Premier Physical Therapy and Sports Performance And All Named Does and Roes
- Negligent Infliction of Emotional Distress- As Against Defendant Brady K. Powell And All Named Does and Roes
- Intentional Infliction of Emotional Distress- As Against Defendant Brady K. Powell And All Named Does and Roes
- Assault and Battery- As Against Defendant Brady K. Powell And All Named Does and Roes
The suit seeks general, compensatory, special, treble, and punitive damages as well as medical and incidental expenses and damages for past and future pain, suffering, mental anguish, loss of enjoyment of life, loss of earning capacity and wages, loss of past and future household services, and costs of suit and attorney's fees.
This is the second lawsuit filed by Eglet Adams on behalf of a woman who alleged sexual assault by Powell while undergoing medical care at LV PPTSP. Earlier this year, another Las Vegas law firm filed a lawsuit on behalf of an additional Powell victim.
On February 2, 2023, The Las Vegas Review Journal (RJ) reported about Powell’s arrest, stating that the North Las Vegas Police Department arrest report showed Powell was arrested on February 1, 2023, at LV PPTSM. The RJ noted that Powell faced two gross misdemeanor counts of open or gross lewdness and was booked into the North Las Vegas Community Correctional Center.
The court docket shows that in April, a Clark County grand jury indicted Powell on seven counts of felony/gross misdemeanor charges of open and gross lewdness. His criminal jury trial is currently set for June 26, 2023.
